THIS TELEHEALTH CONSENT DESCRIBES THE NATURE OF REMOTE SERVICES PROVIDED THROUGH POPPY HEALTH (“POPPY,” “WE,” “US,” OR “OUR”) AND OBTAINS YOUR INFORMED CONSENT TO RECEIVE SUCH SERVICES. BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THIS TELEHEALTH CONSENT.

NATURE OF TELEHEALTH SERVICES Telehealth involves the delivery of health-related services using electronic communications, information technology, or other means between a licensed practitioner and an individual who are not in the same physical location. The Services provided through Poppy may include remote, asynchronous interactions, including intake forms, written communications, and other digital exchanges. While telehealth may offer certain benefits, including increased convenience and access to care, it also presents inherent limitations and risks. Telehealth services are not appropriate for all conditions and are not a substitute for in-person care in all cases. As a condition of using the Services, you are required to review and agree to this Telehealth Consent. By proceeding, you acknowledge and accept the nature of telehealth services, including their limitations and risks.

ROLE OF POPPY Poppy is not a healthcare provider and does not provide medical care, diagnosis, or treatment. Poppy operates solely as a platform that facilitates connections between users and independent licensed practitioners. Any health-related guidance, recommendations, or services are provided exclusively by independent practitioners. To the fullest extent permitted by law, Poppy does not control or direct practitioner decisions and is not responsible for the acts or omissions of any practitioner.

NATURE OF PRACTITIONER SERVICES Practitioners who provide services through the platform may review information you submit and offer guidance, recommendations, or herbal formulations based on their professional judgment. These services are based on the information you provide and may be limited by the absence of an in-person evaluation. The Services may involve asynchronous communication, meaning that practitioners may not respond in real time and there may be delays between submission and response.

NOT EMERGENCY CARE The Services are not intended for use in emergency situations. If you are experiencing a medical emergency, call 911 or seek immediate in-person medical care.

Poppy and practitioners do not guarantee response times, and communications submitted through the platform may not be reviewed immediately.

LIMITATIONS OF TELEHEALTH Telehealth services have inherent limitations. Information used by practitioners is based on what you provide and may be incomplete, inaccurate, or subject to misinterpretation. The absence of a physical examination may limit a practitioner’s ability to fully assess your condition. Telehealth may result in limitations in the ability to fully evaluate a condition, which may increase the risk of incomplete assessment or delayed identification of underlying issues. Technical issues, including connectivity problems, system errors, or platform outages, may affect the availability, timeliness, or quality of communications. Practitioners may determine that your condition is not appropriate for remote care and may recommend that you seek in-person evaluation or discontinue use of the Services.

POTENTIAL RISKS Potential risks of using telehealth services include, but are not limited to, delays in evaluation or recommendations, incomplete or inaccurate information affecting outcomes, limitations in diagnosis or treatment, misunderstandings between you and the practitioner, technical failures affecting communication, and risks to data privacy despite reasonable safeguards. There is no guarantee that the Services will result in any specific outcome or improvement.

ALTERNATIVES TO TELEHEALTH You may choose to seek care through traditional in-person services instead of using telehealth. In certain situations, in-person care may be more appropriate or necessary.

PRIVACY AND SECURITY Telehealth services involve the electronic transmission of personal information. While Poppy implements safeguards designed to protect your information, no system can guarantee absolute security. There is a risk that communications or data could be accessed or disclosed in ways beyond our control. You are responsible for using secure environments and devices when accessing the Services.

YOUR RESPONSIBILITIES You agree to provide accurate, complete, and up-to-date information and to update such information as necessary. You are responsible for making informed decisions about your care and for seeking additional or in-person care when appropriate. You acknowledge that recommendations provided through the Services are based solely on the information you provide and may change if additional information becomes available.

NO GUARANTEE OF OUTCOMES Recommendations provided through the Services are based on practitioner judgment and available information. Poppy does not guarantee any specific results, outcomes, or improvements from use of the Services or products.

CONSENT TO RECEIVE TELEHEALTH SERVICES By using the Services, you acknowledge that you have read and understand this Telehealth Consent, including the nature of telehealth services, their limitations, and associated risks, and you voluntarily consent to receive services through this format.
